Reynolds and Philip Morris USA, 63.4% of voters upheld the law in November 2022.10 SB 793 went into effect on 21 December 2022, making California the second US state to prohibit sales of flavoured tobacco, after Massachusetts.10 Tobacco retailers were required to remove all prohibited flavoured products by the effective date.11 The penalty for violating SB 793 is a $250 fine for each infraction.8 In December 2022, the California Department of Tax and Fee Administration notified licensed retailers, distributors and wholesalers via email/mail and posted a notice on its website.12 In January 2023, the California Department of Public Health sent postcards and letters notifying retailers of the law and its website displayed fact sheets and frequently asked questions.12 13 Over 60 countries have adopted similar policies.14 For example, the European Union prohibits the sale of explicit flavours (effective May 2016), including menthol (effective May 2020), in cigarettes and roll-your-own tobacco.15 The Netherlands extended these restrictions to include flavoured vape products in January 2024.16 Similarly, Canada banned flavoured cigarettes, little cigars and blunt wraps (excluding menthol) in 2009, with many provinces implementing menthol bans in May 2015, followed by a federal menthol ban in October 2017.17 Sales data showed zero sales postban in all provinces.18 Observational studies in the US report varying levels of early-stage compliance with local flavoured tobacco restrictions
